Terms of Service

Welcome to TinyYears. These Terms of Service ("Terms") govern your access to and use of the TinyYears mobile application and related services (collectively, the "Service"), operated by ByteNero ("we", "us", or "our"). By using TinyYears, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 16 years of age and agree to comply with these Terms. If you do not agree, you must not use the Service.

2. Account Registration

To use TinyYears, you must create an account with a valid email address. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use TinyYears only for its intended purpose as a family journal and baby tracking application. You must not:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Upload content that is abusive, harmful, threatening, or violates the rights of others.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Create multiple accounts to circumvent restrictions or abuse the Service.
• Use automated tools, bots, or scrapers to access the Service.

4. Your Content

You retain full ownership of all content you create within TinyYears, including journal entries, photos, voice recordings, and tracking data ("Your Content"). By using the Service, you grant us a limited licence to store and transmit Your Content solely for the purpose of providing the Service to you.

Due to our end-to-end encryption, we cannot access, view, or use Your Content for any other purpose. Your Content is encrypted on your device before being transmitted to our servers.

5. Family Sharing and Invitations

When you invite family members to follow a child's profile, you are granting them access to view the data associated with that child. You are responsible for managing who has access and can revoke access at any time. By inviting someone, you confirm that you have the right to share this information.

6. Subscriptions and Payments

TinyYears offers both free and premium subscription tiers. For premium subscriptions:

• Subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective terms.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions through your device's app store settings.
• Refunds are handled by the respective app store according to their refund policies.

Physical Products

TinyYears offers physical products (storybooks, merchandise) that are fulfilled by third-party print partners. Orders for physical products are processed via Stripe and are subject to separate shipping and return policies displayed at the time of purchase.

7. AI-Generated Content

TinyYears uses artificial intelligence to generate storybook content, daily summaries, and insights. While we strive for quality, AI-generated content may contain inaccuracies. You acknowledge that:

• AI-generated storybooks and summaries are for entertainment and personal use.
• AI-generated content should not be relied upon for medical, health, or safety decisions.
• You are responsible for reviewing AI-generated content before sharing or printing it.

8. Intellectual Property

The TinyYears name, logo, design, and all related intellectual property are owned by ByteNero. You may not use our trademarks, logos, or branding without our prior written consent. The Service's source code, design, and architecture are proprietary and protected by copyright and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• ByteNero shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
• We do not guarantee uninterrupted or error-free operation of the Service.

10. Indemnification

You agree to indemnify and hold harmless ByteNero, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

You may stop using the Service and delete your account at any time from within the app. We may also suspend or terminate your access if:

• You violate these Terms.
• Your use of the Service poses a risk to other users or our infrastructure.
• We are required to do so by law.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the app and on this page. Continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
